By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, browsing, or otherwise using any part of the Service, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional terms, conditions, policies, and guidelines that are referenced herein, published on the Service, or that may apply to specific features, products, or services offered through the Service. Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference into these Terms.

We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time. When we make changes, we will post the revised Terms on this page, update the “Last Updated” date at the top of these Terms, and in some cases, we may provide you with additional notice (such as an email notification to the address associated with your account, or an in-Service announcement). It is your responsibility to review these Terms periodically for changes. Your continued use of the Service after the date any such changes become effective constitutes your irrevocable acceptance of the new Terms. If you do not agree to abide by these or any future Terms, your sole remedy is to cease all use of the Service.

2. Eligibility and Account Registration

2.1 Eligibility

To use the Service, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater, and legally capable of forming a binding contract with SMS Labs LLC. By accessing or using the Service, you represent and warrant that you meet this eligibility requirement, that you are not barred from receiving the Service under the laws of the United States or other applicable jurisdiction, and that all registration information you submit is accurate, truthful, and complete. SMS Labs LLC may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time without prior notice.

2.2 Account Registration

To access certain enhanced features of the Service, such as saving job listings, applying to jobs, creating and maintaining a profile, or utilizing AI-powered tools, you will be required to register for an account. When registering for an account, you agree to:

• Provide Accurate Information: Supply accurate, current, and complete information as prompted by the registration form. You agree that the information you provide will be kept current and truthful.
• Maintain Data Integrity: Promptly update your registration data and profile information to keep it true, accurate, current, and complete. If you provide information that is untrue, inaccurate, not current, or incomplete, or if SMS Labs LLC has reasonable grounds to suspect so, we may suspend or terminate your account.
• Account Security: Maintain the confidentiality and security of your password and identification credentials. You are solely responsible for all activities that occur under your account. Notify SMS Labs LLC immediately of any unauthorized use or breach of security.
• Prevent Unauthorized Access: Properly log out at the end of each session, especially on public or shared devices.

SMS Labs LLC will not be liable for any loss or damage arising from your failure to comply with this section.

3. Use of the Service

3.1 Job Search and Application Mechanisms

The Service functions as a digital platform connecting individuals seeking employment (“Job Seekers”) with job listings posted by third-party employers, recruiters, or staffing agencies (“Employers”).

Job Listing Nature: SMS Labs LLC acts solely as a passive conduit for the distribution and publication of job listings. We do not create, verify, or endorse the content of these listings and do not guarantee their validity, accuracy, completeness, timeliness, or legality.

Application Process: When you apply for a job through the Service, your application materials (including your resume, cover letter, portfolio, work samples, and any other information you submit) will be transmitted directly to the Employer. Once submitted, it is solely within the Employer’s discretion to review or act on your application. SMS Labs LLC is not responsible for hiring decisions, Employer communications, or any loss or damage arising from reliance on Employer information.

Direct vs. Redirected Applications: Some listings allow for direct application through our Service, while others redirect you to external websites (e.g., an Employer’s career site) to complete your application. We have no control over third‑party websites and strongly advise reviewing their terms and privacy policies before submitting personal information.

Employer Interactions: Any interactions, communications, or disputes between you and an Employer are solely between you and that third party. SMS Labs LLC disclaims all liability arising from them.

3.2 User Content — Uploads, Submissions, and Data

The Service allows Job Seekers to upload, post, store, share, and otherwise make available various types of content and data (“User Content”), including but not limited to resumes, cover letters, portfolios and work samples, avatars, and other profile information.

By submitting User Content, you grant SMS Labs LLC a worldwide, non‑exclusive, royalty‑free, fully paid, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, publish, and perform your User Content in connection with operating and improving the Service (including promoting and redistributing parts of the Service in any media). This license extends to allowing Employers to access and use your User Content for legitimate recruitment and hiring purposes, subject to your privacy settings.

You represent and warrant that you have all necessary rights to publish and use your User Content as contemplated by these Terms and that it does not infringe or violate the rights of others or any law. You are solely responsible for your User Content and the consequences of submitting it.

3.3 AI Resume and Cover Letter Generator

The Service may include an AI‑powered resume and cover letter generator to assist with creating or refining application materials.

• AI‑Generated Content & Limitations: Outputs may be inaccurate, incomplete, biased, or contain “hallucinations.”
• Accuracy and Suitability: SMS Labs LLC does not guarantee the accuracy or suitability of AI output. You are responsible for reviewing and verifying content before use.
• No Professional Advice: The AI generator is a tool, not professional advice.
• Data Usage for Improvement: Input data (excluding PII subject to our Privacy Policy) and outputs may be used to improve our models and features.

3.4 Public Profile and Sharing Settings

You may choose to make parts of your profile publicly visible or shareable with Employers or third parties. Public information may be accessible to anyone, including search engines, and outside of SMS Labs LLC’s control. If you share information with Employers, they may download, store, use, and redistribute it per their own policies. You are solely responsible for your privacy settings and information you choose to share.

4. Prohibited Conduct

You agree not to engage in any of the following activities:

• Illegal Use: Use of the Service in violation of any law or regulation.
• Fraudulent or Misleading Activity: Providing false information or misrepresenting identity, qualifications, or history.
• Harmful Content: Posting content that is infringing, defamatory, obscene, abusive, hateful, or otherwise objectionable, or that violates others’ rights.
• Impersonation/Misrepresentation.
• Malicious Code: Uploading viruses, worms, or other harmful code.
• Service Interference: Disrupting or attempting to gain unauthorized access to the Service or related networks.
• Unauthorized Access: Attempting to access accounts, systems, or networks without authorization.
• Data Harvesting/Scraping: Automated collection of data without written permission.
• Spamming/Unsolicited Communications.
• Abuse of AI Tools.
• Circumvention: Bypassing security or protective measures.
• Competitive Use: Unpermitted commercial exploitation or building a competing service.
• Deep Linking/Framing: Linking, framing, or mirroring without prior written permission.

5. Intellectual Property Rights

5.1 Our Proprietary Rights

All intellectual property rights in the Service and its entire contents, features, and functionality (excluding User Content) are and will remain the exclusive property of SMS Labs LLC, its licensors, or other providers, and are protected by applicable laws.

Trademarks: submitmyshit.com, the SMS Labs LLC logo, and related marks are trademarks of SMS Labs LLC or its affiliates or licensors. Do not use these without prior written permission.

Limited License: Subject to your compliance with these Terms, SMS Labs LLC grants you a limited, non‑exclusive, non‑transferable, non‑sublicensable, revocable license to access and use the Service for personal, non‑commercial job‑seeking purposes. Restrictions apply.

5.2 Your Rights in User Content

You retain ownership of your User Content, subject to the license granted in Section 3.2.

6. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, security, reliability, quality, and non‑infringement. Without limiting the foregoing, SMS Labs LLC makes no warranty that:

1. The Service will meet your requirements or lead to employment;
2. The Service will be uninterrupted, timely, secure, or error‑free, or that defects will be corrected;
3. Results obtained from use of the Service will be accurate, complete, reliable, current, or error‑free;
4. The quality of any listings, products, services, or information will meet expectations;
5. Any data you submit will be secure or free from unauthorized access, loss, or corruption; or
6. The Service will be compatible with your hardware or software.

Content on the Service (including AI‑generated content and Employer content) is for general information and recruitment purposes and does not constitute professional advice. Use at your own risk.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SMS LABS LLC OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PURE ECONOMIC DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR THIRD‑PARTY CONDUCT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SMS LABS LLC’S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID SMS LABS LLC FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

8. Indemnification

You agree to defend, indemnify, and hold harmless SMS Labs LLC and its affiliates, officers, directors, agents, employees, partners, and licensors from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

• Your access to, use of, or inability to use, the Service;
• Your User Content (including alleged infringement or violation of rights);
• Your connection to the Service;
• Your violation of these Terms or applicable law;
• Your violation of any rights of another; or
• Any actions taken by a third party using your account or password.

We may assume exclusive defense and control of matters otherwise subject to indemnification. You will not settle any matter without our prior written consent.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict‑of‑law principles.

9.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms shall be finally settled by binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable rules, as modified by these Terms, before a single arbitrator in Denver, Colorado. Judgment on the award may be entered in any court of competent jurisdiction.

9.3 Class Action Waiver

YOU AND SMS LABS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable, this Section 9 (arbitration/class waiver) is null and void.

9.4 Exceptions

Nothing herein waives the right to bring an individual small‑claims action, pursue agency enforcement, seek injunctive relief in aid of arbitration, or file an action regarding intellectual‑property infringement.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for reasons including but not limited to:

• Material or repeated breaches of these Terms;
• Prohibited conduct under Section 4;
• Legal or regulatory requirements;
• Discontinuation or material modification of the Service;
• Technical or security issues;
• Extended inactivity (as we determine);
• Suspected fraudulent, abusive, or illegal activity; or
• To protect the rights, property, or safety of SMS Labs LLC, users, or the public.

If you terminate your account, your right to use the Service ceases immediately. We may delete your account and related User Content at our discretion. Provisions that by their nature survive termination will survive.

11. Miscellaneous Provisions

11.1 Entire Agreement

These Terms, together with the Privacy Policy and any other notices or policies posted on the Service, constitute the entire agreement between you and SMS Labs LLC regarding the Service and supersede all prior agreements.

11.2 Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced with a valid provision that most closely reflects the parties’ original intent.

11.3 Waiver

No waiver of any term is a continuing waiver, and failure to enforce a term is not a waiver.

11.4 Assignment

You may not assign your rights or obligations without prior written consent. We may assign without consent to an affiliate or in connection with merger, acquisition, reorganization, or sale of assets.

11.5 Feedback and Suggestions

Submissions you provide are non‑confidential and become the sole property of SMS Labs LLC. We may use and disseminate them without acknowledgment or compensation.

11.6 Third‑Party Services and Links

The Service may contain links to third‑party sites or services not owned or controlled by SMS Labs LLC. We are not responsible for their content, policies, or practices. Your use of third‑party resources is at your own risk.

11.7 Monitoring and Enforcement

We may remove or refuse to post User Content; take action we deem appropriate (including disclosure of your identity) if we believe content violates these Terms or others’ rights; cooperate with law enforcement; and terminate or suspend access for any or no reason. YOU WAIVE AND HOLD HARMLESS SMS LABS LLC FROM ANY CLAIMS RESULTING FROM ACTIONS TAKEN DURING OR AS A RESULT OF INVESTIGATIONS BY SMS LABS LLC OR LAW ENFORCEMENT.

11.8 Changes to Service

We may modify or discontinue the Service (or any part) with or without notice. We are not liable for any modification, suspension, or discontinuance.

11.9 Notices

We may provide notices by email, postal mail, or postings on the Service.

11.10 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, acts of authorities, fires, floods, strikes, or shortages.

11.11 Relationship of the Parties

No joint venture, partnership, employment, or agency relationship is created by these Terms or your use of the Service.

11.12 International Use

The Service is controlled from the United States. If you access it from outside the U.S., you are responsible for local compliance and agree not to use content in any manner prohibited by applicable laws.
